Fitness center sued after machine allegedly breaks and injures patron

GRETNA – A man who claims he was injured when a piece of fitness equipment broke is suing a local gym.

Ivy Batiste filed suit against Elmwood Fitness Center and Ochsner Health Systems in the 24th Judicial District Court on July 21.

The plaintiff asserts he was working out at Elmwood Fitness Center located at 200 W. Esplanade Ave. in Metairie on July 24, 2013 when a piece of fitness equipment broke and struck him. Batiste alleges that he received serious injuries in the incident.

The defendant is accused of failing to maintain equipment in a safe manner and failing to warn guests and patrons of unreasonably safe workout equipment.

An unspecified amount in damages is sought for pain and suffering, medical expenses and loss of enjoyment of life.

Batiste is represented by Brian G. Shearman of New Orleans-based Shearman - Denenea LLC.

The case has been assigned to Division J Judge Stephen C. Grefer.
