Woman sues elevator company after light fixture falls on her

NEW ORLEANS – A woman has filed suit against an elevator operator for negligence in the maintenance, inspection, and repair of an elevator she claims she was injured in when a light fixture fell on her.

Charlene Cook filed suit against Irish Channel Funding LLC, Atain Insurance Company, American Crescent Elevator Corporation and their insurer in the Orleans Parish Civil District Court.

The plaintiff claims to have suffered severe and disabling injuries due to an unreasonably dangerous condition in an elevator operated by the defendants.

The defendant is accused of failing to provide proper maintenance to keep the elevator in a safe condition for customers, failing to make a timely inspection of the area in question, failing to properly train employees as to methods of maintenance to prevent this type of accident, failing to remedy an unsafe condition, allowing a dangerous condition to exist and failing to keep the area in proper working condition.

The plaintiff is seeking more than $50,000 in damages for physical pain and suffering, mental anguish, medical expenses, loss of earning, loss of earning capacity, permanent disability to the body and cost of legal fees.

Charlene Cook is represented by Roderick Alvendia from the Law office of Alvendia, Kelly & Demarest LLC in New Orleans.

The case has been assigned to Division F Judge Christopher J. Bruno.
