NEW ORLEANS – Court of Two Sisters allegedly violated multiple state and city codes pertaining to noise ordinances.
Peterson M. Yokum and Polly Elizabeth Anderson filed suit against Jos. Fein Caterer Inc., Fein Management LLC, 613 Royal Street LLC, Karno 613 Royal Real Estate LLC and their insurer in the Orleans Parish Civil District Court on Aug. 5.
Yokum and Anderson claim that since Aug. 5, 2013, the Court of Two Sisters restaurant, operated by Jos. Fein Caterer Inc. and Fein Management LLC, has emanated loud noises through its premises, causing blatant discomfort to neighbors Yokum and Anderson and any person of ordinary sensibilities.
Court of Two Sisters, located on 612-614 Bourbon Street, 618 Bourbon Street and 613 Royal Street in the Vieux Carre district, regularly serves a brunch buffet in an open air courtyard between 9 a.m. and 3 p.m. accompanied by live music and entertainment.
The defendants are accused of violating multiple state and city codes.
Specifically, the defendants are allegedly deemed responsible for violating the Louisiana Civil Code Articles 667 and 2315 for failure to train its employees, failure to sustain adequate sound control and measurement equipment, failure to properly measure sound levels resonating from their business premises, and failure to comply with the City of New Orleans’ noise ordinances and local and state laws governing alcoholic beverages.
The plaintiffs are seeking an unspecified amount in damages for pain and suffering, mental anguish, loss of enjoyment of their home, inabilities to sleep, entertain and take solace in the privacy of their home.
