NEW ORLEANS – A man is suing over the allegedly faulty and unsafe premises at The Riverwalk where he claims injuries in a trip and fall.

Donald Brauner, and wife Betty, filed suit against the Port of New Orleans, The Howard Hughes Corporation, Frank P. Quinn, Ramelli Janitorial Service Inc., VCC LLC and Omniplan Inc. in the Orleans Parish Civil District Court on Aug. 15.

Donald and Betty Brauner claim that on May 30, Brauner was visiting The Riverwalk, located at 500 Port of New Orleans Place in New Orleans, when unexpectedly, he tripped and fell on uneven tile at the entrance. As a result of the incident, the plaintiff alleges he suffered debilitating injuries to the makeup, tissue, and muscles of his body, specifically, to his head, neck and back.

The defendants are accused of failing to manage the property, maintain safe conditions, correct any hazardous conditions, have property up to state or city code, supervise the area in question, allow the existence of unsafe practices, appropriately inspect premises, apply proper safety protocol, utilize the appropriate tile, provide warning signs of dangerous conditions and provide an even walkway at the entrance of the premises.

The plaintiff is seeking an unspecified amount in damages for pain and suffering, mental anguish, medical expenses, loss of future income and disabilities.

Additionally, the plaintiff’s wife, Betty Brauner, is seeking compensation for loss of consortium, companionship and marital services.
