GRETNA – An HVAC installation company and its insurer are being sued by a local homeowner who claims the venting installed in his home is causing water damage.
Paul Chatelain filed suit against ETB Enterprises Inc. and Alacrity Services LLC in the 24th Judicial District Court on Aug. 13.
Chatelain alleges that due to a fire at his residence in Jefferson Parish on Oct. 11, 2011 he contracted ETB Enterprises to make repairs to his home that were completed in February 2012. The plaintiff contends that Alacrity provided a quality assurance guarantee for three years and that before that time was up the HVAC system installed by ETB began producing excessive condensation causing structural and cosmetic damage to the home. Chatelain claims that the defendants attempted to repair the HVAC system on four occasions, but were unable to to do so. However, the plaintiff asserts Alacrity has refused to provide relief for their guarantee on he work of ETB.
The defendant is accused of negligent breach of contractural duty.
Damages in the amount of $22,800 for the replacement of the HVAC unit plus the cost of property deterioration is sought by the plaintiff.
Chatelain is representing himself pro se in the case.
The case has been assigned to Division O Judge Ross P. LaDart.
