GRETNA – A convenience store is suing its property insurer for allegedly not covering damage from Hurricane Isaac.

24/7 Discount Inc. filed suit against Great Lakes Reinsurance (UK) PLC in the 24th Judicial District Court on Aug. 28.

The plaintiff alleges that on Aug. 29, 2012, when Hurricane Isaac struck the area, it had coverage in place by Great Lakes Reinsurance (UK) PLC. 24/7 Discount Inc. asserts that the storm caused massive wind and rain damage to their convenience store located at 3500 Jefferson Highway in Jefferson. The plaintiff contends that the defendant failed to fulfill its duties required under the policy.

The defendant is accused of failing to pay all damages due under the policy, failing to include all damages in scope of damage estimate, failing to bring in qualified professionals to assess all damages, refusing to pay matching costs for all damaged items, overly depreciating the value of the damaged items, refusing to explain depreciation, failing to pay for post-catastrophe price increases, failing to timely and properly communicate with the insured and failing to investigate and pay in good faith.

An unspecified amount in damages is sought for full value of damaged property, loss of use, recoverable depreciation, mold damage and remediation, debris clean up and removal, cost of compliance, mental anguish, loss of business income, attorney’s fees, case costs, contents, food spoilage and penalties under state law.
