In a compelling legal battle that highlights the ongoing struggle for accessibility rights, an individual has filed a lawsuit against two companies, alleging violations of disability laws. On May 1, 2025, Daniel Todd lodged a complaint in the United States District Court for the Western District of Louisiana against Antoon Properties I, L.L.C., and Antoon Hospitality Group, L.L.C.

The case revolves around Todd's claim that the defendants have failed to comply with the Americans with Disabilities Act (ADA) and the Louisiana Commission on Human Rights (LCHR). Todd, who resides in Rapides Parish, Louisiana, is a qualified individual with a disability under these laws due to his reliance on a wheelchair following the loss of his leg. The properties in question include Popeyes Louisiana Kitchen located at 1001 MacArthur Drive in Alexandria, Louisiana. According to Todd's complaint, he encountered several architectural barriers during his visit to this establishment which deterred him from entering. These barriers included improperly installed restroom facilities and inaccessible routes from parking spaces to the restaurant entrance.

Todd argues that these obstacles are discriminatory as they deny him full and equal enjoyment of goods and services offered by the business. He asserts that removing these barriers is readily achievable without imposing undue burden on the defendants. Furthermore, Todd plans to return to the property but fears encountering similar impediments unless corrective measures are taken.

The plaintiff seeks declaratory and injunctive relief from the court, requesting that it orders the defendants to make necessary alterations ensuring compliance with ADA and LCHR standards. Additionally, Todd demands compensatory damages for injuries sustained due to alleged discrimination along with reasonable attorneys' fees and costs incurred during litigation.

Representing Daniel Todd are attorneys Andrew D. Bizer, Garret S. Dereus, and Eva M. Kalikoff from Bizer & DeReus LLC based in New Orleans. The case has been assigned Case ID 1:25-cv-00586 but details regarding presiding judges remain unspecified.
