NEW ORLEANS – Allegedly faulty tile has led to lawsuit between a local hotel and a construction material distributor.
Four Points French Quarter Hotel filed suit against Viking Distributors Inc., Interior Concepts LTD and IRIS Ceramic US in the Orleans Parish Civil District Court on Sept. 26.
Four Points French Quarter Hotel argues over the last year the defendant, Viking Distributors, has sold and distributed defective tile to the plaintiff. Four Points began to notice the tile it purchased was both defective and discolored approximately half a year ago, rendering it not fit for its intended purpose, the suit says.
Four Points notified Viking Distributors of the alleged defects, then proceeded to order the defendant to repair the defective tile, however, the defendant has refused, the suit says.
Four Points asserts Viking Distributors has violated a breach of contract agreement with the petitioner.
The plaintiff is seeking an unspecified amount in damages for costs to replace the tile, lost profits and attorney’s fees.
The plaintiff is represented by Jefferson R. Tillery of Jones Walker LLP.
The case has been assigned to Div. N Judge Ethel S. Julien.
