GRETNA – A number of local gas stations are suing their commercial property insurer for allegedly not properly covering damages they received in Hurricane Isaac.
Brothers Lapalco filed suit against Arch Specialty Insurance Company in the 24th Judicial District Court on Aug. 29.
Brothers Lapalco contends their gas stations located at 3659 Lapalco Blvd. in Harvey, 6600 Veterans Blvd. in Metairie, 2901 U.S. Highway 90 in Avondale, 2000 Carol Sue in Terrytown, 7001 Bullard Ave. in New Orleans and 1675 Gause Blvd. in Slidell were covered by an insurance policy issued by Arch Specialty Insurance Company when Hurricane Isaac struck the area on Aug. 29, 2012.
The plaintiff asserts that all of their locations experienced property damage in the hurricane including to the real estate, goods, canopies, gas pumps and signs in addition to loss of business income. Brothers Lapalco claim although the provided satisfactory proof of loss within the required time period the defendant to properly assess and pay for their damages.
The defendant is accused of breach of contract.
An unspecified amount in damages are sought by the plaintiff.
Brothers Lapalco is represented by Joseph V. Dirosa Jr. of Metairie.
The case has been assigned to Division F Judge Michael P. Mentz.
