GRETNA – A corporate retail store is being sued by a woman who claims she was injured when she slipped and fell on its premises.
Miriam L. Rivas, and husband Luis J. Cardona, filed suit against Wal-Mart Stores Inc. in the 24th Judicial District Court on Sept. 17.
Rivas claims on Jan. 18 she was shopping at Wal-Mart in Harvey when she slipped on an unknown substance and fell to the floor. The plaintiff alleges she was severely injured in the incident.
The defendant is accused of failing to maintain a safe place for business, allowing aisles to become and remain dangerous, failing to warn of dangers, failing to protect, failing to inspect and keep the premises in a safe condition, failing to discover and unreasonably dangerous condition, failing to take reasonable steps to prevent injury and creating a dangerous condition.
An unspecified amount in damages is sought for pain and suffering, disability, mental anguish, medical expenses, loss of enjoyment of life, loss of use and fitness of parts of the body, bodily disability, impairment of psychological functioning, disability for engaging in recreation, destruction of earning capacity, loss of support, loss of society and loss of consortium.
Rivas is represented by Robert B. Evans III of New Orleans-based Burgos & Evans LLC.
The case has been assigned to Division B Judge Cornelius E. Regan.
