NEW ORLEANS – A historic hotel is being sued by a patron who claims she slipped and fell while walking across the entranceway of their rooftop pool.
Elaine Amplo filed suit against Brothers Property Corporation, doing business as Le Pavillon Hotel, Great American Insurance Company and American Financial Group Inc. in the Orleans Parish Civil District Court on Sept. 11.
Amplo states that on Sept. 14, 2013, she was a patron of the Le Pavillon Hotel. On this date, the petitioner was leaving the rooftop pool, where suddenly and without warning, she allegedly slipped and fell near the entrance of the hotel. The plaintiff sustained fractures to her right wrist as well as severe nerve damage as a result of the incident.
In late September 2013, Amplo proceeded to undergo surgery for her right wrist injury.
The defendants are accused of failing to correctly mop up the premises, warn patrons of any slippery substances on the entranceway to the rooftop pool, place mats at the entranceway to the rooftop pool, and allowing a hazardous condition to exist inside the entranceway to the rooftop pool.
The plaintiff is seeking an unspecified amount in damages for pain and suffering, mental agony, medical expenses, disabilities and loss of enjoyment of life.
Attorney Robert Angelle represents the petitioner.
The case has been assigned to Div. L Chief Judge Kern A. Reese.
Case no. 2014-08938.
