Schaumburg Elementary School teacher alleges students physically assaulted her

NEW ORLEANS – A local elementary school librarian is alleging her students physically assaulted her while breaking up a fight.

Jacinta White filed suit against Louisiana Department of Education, Orleans Parish School Board and Renew Charter Schools in the Orleans Parish Civil District Court on Sept. 12.

White states that on Sept. 13, 2011, she was employed as a librarian at Schaumburg Elementary School located within Orleans Parish. On this date, two students allegedly started a physical altercation in which the plaintiff attempted to arbitrate. As a result of the petitioner’s interference, she was allegedly smacked numerous times by the students causing her to fall to the ground writhing in pain.

The plaintiff contends she sustained severe injuries to her back, head, and kidneys requiring extensive medical treatment as a result of the incident.

White has received relief payment under the Louisiana Workers’ Compensation law in the exact amount of two-thirds of her average weekly salary. However, she claims the actions of the students constitute physical contact and she should be awarded “assault pay."

The case has been assigned to Div. N Judge Ethel S. Julien.
