Customer claims disability from Dollar General slip and fall

GRETNA – A discount retailer is being sued by a customer who claims she was disabled in fall on its  premises.

Cecilia Bush filed suit against Dolgencorp LLC and Dollar General in the 24th Judicial District Court on Sept. 23.

Bush claims that she was a customer at the Dollar General located at 7123 Veterans  Memorial Blvd. in Metairie on Oct. 2, 2013 when she slipped on a liquid substance and fell to the store’s floor. The plaintiff alleges she received permanent, painful injuries in the incident, including to her right knee, that have necessitated medical treatment.

The defendant is accused of permitting a hazardous slippery condition to exist, having notice of the hazard, failing to exercise reasonable care, failing to warn of the slippery condition, failing to employ adequate and regular cleanup procedures and strict liability.

An unspecified amount in damages is sought for physical pain and suffering, emotional pain and suffering, medical expenses, loss of earnings, loss of earning capacity and permanent disability.

The case has been assigned to Division F Judge Michael P. Mentz.
