Big Lots sued by customer for alleged permanent physical impairment over fall on sidewalk

GRETNA – A discount retailer and its landlord are being sued by a customer who claims he was severely injured in a fall on the sidewalk at its property.

Michael Denham filed suit against Eagle Enterprises of Jefferson Inc. and Big Lot Stores Inc. in the 24th Judicial District Court on Oct. 13.

Denham claims that on Dec. 15, 2013 he was a customer at the Big Lots store located at 755 Veterans Memorial Blvd. in Metairie when he stepped into a hole on the sidewalk in front of the store and fell to the pavement. The plaintiff alleges that due to the fall he received severe and disabling injuries to his foot, ankle and body as a whole that required medical treatment.

The defendant is accused of failing to properly maintain the premises, failing to properly clean the premises, failing to wan plaintiff of a hazard, failing to inspect the premises, failing to provide proper lighting,failing to properly train store personnel and failing to report hazards and unsafe conditions.

An unspecified amount in damages is sought for medical expenses, impatient of earning, loss of wages, mental anguish, distress, loss of life’s pleasures, loss of enjoyment, disabilities and permanent physical impairment.

Denham is represented by Scott W. McQuaig of Metairie-based McQuaig & Associates LLC.

The case has been assigned to Division H Judge Glenn B. Ansardi.
