Wal-Mart sued by woman who claims injury from trip and fall over boxes

GRETNA – A corporate retailer is being sued by a woman who claims she was severely injured after tripping over boxes that fell from a cart pulled by a store employee.

On T. Tran, and husband Dinh Harry Nguyen, filed suit against Wal-Mart Louisiana LLC, Wal-Mart Stores Inc. and two unknown employees in the 24th Judicial District Court on Nov. 19.

Tran contends that on Nov. 24, 2013 she was was a customer at the Eval-Mart Super Center located at 4810 Lapalco Blvd. in Marrero and was walking down an aisle when falling boxes from a cart pulled by a Wal-Mart employee caused her to fall onto her hands, lower back and buttocks. The plaintiff claims that due to this she suffered severe and disabling injuries and had to receive treatment by a chiropractor, orthopedist and hand specialist.

The defendant is accused of failing to observe the plaintiff, failing to maintain an appropriate lookout, negligently allowing boxes to fall, negligently pulling the cart full of boxes and creating a dangerous situation.

An unspecified amount in damages is sought for physical pain and suffering, discomfort, mental anguish, aggravation, annoyance, disability, mental anguish, medical expenses, lost wages, loss of enjoyment of life, loss of function of parts of body, impairment of psychological functioning, disability from engaging in recreation and destruction of earning capacity.

Tran is represented by attorney Tu Thomas Hoang of Harvey.

The case has been assigned to Division B Judge Cornelius E. Regan.
