GRETNA – Lowe's is facing a lawsuit by an incarcerated man who is representing himself and seeking damages for alleged disability stemming from injuries he claims to have received in a slip and fall on its property.
Scott Rodrigue filed suit against Lowes Home Improvement Center Incorporated in the 24th Judicial District Court on Nov. 20.
In the handwritten filing sent from the Orleans Parish Prison, Rodrigue alleges that on Dec. 8, 2013 he visited a local Lowe’s store to purchase a 10 gallon bucket of flooring glue. The plaintiff contends that when he was walking through the store he stepped on loose rocks on the floor and lost his footing and slipped and fell. Rodrigue asserts that he received serious injuries to his ribs and elbow in the incident and an ambulance was called to the scene.
The defendant is accused of negligence, failing to provide for the proper storage of goods, failing to warn customers of obstructions, failing to properly train employees, failing to provide a safe route and safety measures and providing inadequate warning.
An unspecified amount in damages is sought for bodily injuries, pain and suffering, mental anguish, medical bills, pharmaceutical bills, apprehension insufficient medical attention, permanent impairment and disability, lost wages, fear and fright, embarrassment, humiliation and aggravation.
Rodrigue is representing himself pro se in the case.
The case has been assigned to Division I Judge Nancy A. Miller.
