Homeowner sued for $12K over alleged breach of contract

GRETNA – A homeowner is being sued by a concrete construction company and its owner for allegedly not completely paying for work done on her home.

Angel Delgado and Angel’s Concrete filed suit against Mary Clark Schmitt in the 24th Judicial District Court on Dec. 11.

The plaintiffs contends that they entered into a contract with Schmitt on Dec. 4, 2013 for $25,313 to provide concrete work at her home located at 84 Royal Palm Drive in Kenner. Delgado and Angel’s Concrete assert they completed the concrete work on the defendant’s home on Jan. 20, 2014 and afterward received a payment of $12,500. However, the plaintiffs claim Schmitt has refused to pay the remainder of the contract.

The defendant is accused of breach of contract.

Damages in the amount of $12,813 is sought by the plaintiff.

Delgado and Angel’s Concrete are represented by attorney Richard R. Arias of Hammond.

The case has been assigned to Division K Judge Ellen Shirer Kovach.
