Mother of four-year-old attacked by pit bull sues

GRETNA – A mother is suing after her four-year-old child was allegedly severely injured in a dog attack.

Angela Perez, individually and on behalf of her minor child, filed suit against Elton Edwards, Jane Doe, W&W Virgil Properties and their insurers in the 24th Judicial District Court on Dec. 11.

Perez asserts that on Oct. 18, 2014 her four-year-old son was chasing after the family's cat at 1204 Virgil St. in Gretna when he was attacked by a pit bull that was being held on property owned by Edwards.

The plaintiff claims that the defendants had four pit bulls on the property that were allowed to roam freely in the neighborhood due to a hole in the fence. Perez alleges that as her child was running by the fence a pit bull reached through the hole and bit into her son’s leg and pulled him through the fence, biting him several times resulting scratches to his face, lacerations to his skull, severe lacerations to his thigh, puncture wounds, bruises and contusions. Perez claims that the family’s cat was also killed in the incident.

The defendant is accused of failing to supervise and control the dogs and gross negligence.

An unspecified amount in damages is sought for physical pain and suffering, discomfort, disability, mental anguish, aggravation, annoyance, medical expenses, lost wages, loss of enjoyment of life, loss of function of parts of body, loss of enjoyment of life, impairment of psychological functioning, disability for engaging in recreation and destruction of earning capacity.

Perez is represented by Tu Thomas Hoang of Harvey-based Cao Law Firm.

The case has been assigned to Division O Judge Danyelle M. Taylor.
