Towing services sued for allegedly breaching legal settlement terms requiring payment of $24K

GRETNA – A tow truck company and its owner are being sued for allegedly breaching a lawsuit settlement agreement.

Wayne Franklin filed suit against Sidney’s Towing LLC and Eric Wayne Bourgeois in the 24th Judicial District Court on March 24.

Franklin contends that on Aug. 21, 2013 he entered into a settlement agreement with Sidney’s Towing and Bourgeois to bring a previous lawsuit to a close. The plaintiff asserts the defendants were to pay him a total of $1,000 per month until the settlement amount was reached in exchange for dismissing all claims against them. However, Franklin claims Sidney’s Towing an Bourgeois only made payments to him over a nine month period from June 2013 to February 2014, for a total of $9,000, before discontinuing them.

The defendant is accused of breach of contract.

An unspecified amount in damages is sought for all amounts due, cost of the lawsuit, attorney’s fees to equal 30 percent of the gross amount.

Franklin is represented by Robert E. Couhig of III of New Orleans-based Couhig Partners LLC and Marcus A. Green of Marrero-based The Green Law Firm.

The case has been assigned to Division F Judge Michael P. Mentz.
