Passenger seeks damages from oncoming rig operator following crash

By The Louisiana Record | May 20, 2015

A St. Tammany Parish man is suing a Baton Rouge insurance business, a North Carolina trucking outfit and a Mississippi individual for alleged vehicular negligence in 2014.

Joseph Eady filed against National Interstate Insurance Co.; Taylor Express Inc. of Hope Mills, N.C.; and Caleb J. Snyder of Amory, Miss., in the U.S. District Court of the Eastern District of Louisiana on May 6, citing liability in an October 2014 roadway incident.

The suit states that Eady was traveling on or about Oct. 29, 2014, as a front seat passenger in a Ford 350 truck driven by Michael Stubblefield headed southbound on Frontage Road near the intersection of U.S. Highway 190 in St. Tammany Parish.

According to the suit, Snyder, driving a tractor-trailer owned by Taylor Express northbound on Frontage, allegedly crossed the double yellow line dividing the road and struck Stubblefield’s truck. Stubblefield allegedly swerved his truck to the right and braked quickly, the filing states, purportedly causing Eady to be thrown about in the truck’s cab and incurring serious neck and back injuries.

Eady declares Snyder responsible, citing careless motor vehicle operation, improper lane usage, inattentiveness, driving too fast, and failing to maintain a proper lookout and control his vehicle. The complaint avers that National Interstate Insurance is liable as the defendant’s insurer.

The plaintiff asserts pain and suffering, anguish and disability; loss of functionality and enjoyment of life; lost wages and earning capacity; and medical expenses. He seeks up to $75,000 in compensation, attorney’s fees, expenses, and costs.

He is represented by John Munoz of Garner & Munoz in New Orleans.
