Budget files $14K suit against customers who allegedly totaled Maxima

NEW ORLEANS – Budget Rent A Car is suing patrons claiming they inflicted $14,000 worth of damages to a 2014 Nissan Maxima.

The suit was filed against Joyce Davis and Leon Huderson in the Orleans Parish Civil District Court on April 6.

On March 14, 2014, the defendant rented a 2014 Nissan Maxima from Budget Rent A Car. Defendant Davis allegedly allowed her fellow defendant Huderson to drive the petitioner’s car. On April 8, 2014, Huderson was traveling down Odin Street attempting to make a U-turn onto Downman Road when he allegedly struck a vehicle being driven by Frederick Jennings. Huderson purportedly hit Jennings’s car on the passenger side while he was headed northbound.

The defendant allegedly caused excessive damage to the plaintiff’s car, rendering the vehicle unserviceable. The petitioner, Budget Rent A Car, estimated the damage to the automobile to be $14,765.21. Davis is also accused of “negligent entrustment” for lending the vehicle to Huderson.

The defendants are further accused of driving in a reckless fashion, driving carelessly, failing to use reasonable care, and negligently operating the vehicle.

The plaintiff is represented by Brian K. Abels and Scott H. Nettles of Boyer, Hebert, Abels & Angelle LLC.

The case has been assigned to Div. N Judge Ethel S. Julien.
