Sam’s Club sued by woman who claims foot was hurt by pallet

GRETNA – Sam's Club is being sued by a customer who claims her foot was caught in a pallet and crushed.

Patricia D. Davis filed suit against Sam’s West Inc. and Earold Swatt in the 24th Judicial District Court on April 10.

Davis claims she was a customer at the Sam’s Club located at 1527 Manhattan Blvd. in Harvey and was reaching for a bottle of water when her foot slipped off a pallet and landed in between the pallet’s slats. The plaintiff alleges she received injuries to her foot, ankle, leg, neck and back in the incident.

The defendant is accused of failing to maintain a reasonably safe area, failing to provide assistance, failing to train employees, failing to warn of a hazard, reckless endangerment and reckless indifference.

An unspecified amount in damages is sought for loss of enjoyment of life, physical disability, mental pain and suffering, disruption of bodily tissues, medical expenses and loss of wages.

Davis is represented by Ron A. Austin of Harvey-based Ron Austin & Associates LLC.

The case has been assigned to Division E Judge John J. Molaison Jr.
