Laborer claiming radial saw cut through hand sues

NEW ORLEANS – A man who claims he was severely injured when a radial saw cut through his hand on the job is suing the owners of the property where the incident occurred and his insurer.

Carlos Alvardo filed suit against Marco Velasquez Vigil, El-Amm Mark and their insurer on April 14 in the Orleans Parish District Court.

The plaintiff claims that on Oct. 24, 2014 he was performing physical labor on a property owned by the defendants in New Orleans. Alvardo alleges he was operating a radial saw when it became stuck and backed up on his hand, cutting it and resulting in severe personal injuries. The plaintiff contends that during this time the defendants did not provide him with the proper equipment or assistance and left the plaintiff to complete the job in a hazardous manner.

The defendant is accused of failing to take into account the safety of others failing to maintain a safe work environment, failing to maintain a proper look out, failing to see what should have been seen, and failing to act as a reasonable and prudent person would under the same or similar circumstances.

An unspecified amount in damages is sought for physical pain, suffering, and discomfort, mental anguish, aggravation and annoyance, disability, medical expenses, loss of enjoyment of life, loss of support, loss of society and bodily disability.

The plaintiff is represented by Robert B. Evans III, Cesar R. Burgos, Gabriel O. Mondino, Robert J. Daigre and George McGregor, of Burgos and Evans LLC.

The case has been assigned to Division J Judge Paula A. Brown.
