Tenant sues landlord, claims nail punctured her foot in apartment

GRETNA – A tenant of an apartment building is suing her landlord claiming that she was injured after stepping on a nail in her apartment.

Betty Joe Franklin filed suit against Thomas Wolfe and his insurer in the 24th Judicial District Court on May 15.

Franklin claims that on July 22, 2014 he entered into a contract to rent an apartment from Wolfe located at 3812 Division St. in Metairie. The plaintiff alleges that on Jan. 16, 2015 she was walking down steps in the apartment when she stepped on a nail sticking out of the carpet. Franklin contends that after she stepped on the nail she fell down the stairs further injuring herself.

The defendant is accused of failing to correct or repair defects, failing to recognize the potential for harm, failing to provide warning of the defect, failing to follow proper procedures and practices, maintaining unreasonably dangerous stairs, failing to ensure the safety of others and failing to correct an unreasonably dangerous condition.

An unspecified amount in damages is sought for severe injuries, psychological damages, loss of enjoyment of life, medical costs, lost wages, loss of earning capacity, aggravation and inconvenience.

Franklin is represented by Christopher D. Glisson of Baton Rouge-based McGlynn, Glisson & Mouton, Attorneys at Law.

The case has been assigned to Division H Judge Glenn B. Ansardi.
