Roofing company sued for allegedly faulty installation, breach of warranty

GRETNA – A roofing contractor and its insurers are being sued for allegedly installing a faulty roof and breach of warranty.

Dr. Samuel Greenberg and Gail Greenberg filed suit against Guardian Roofing Systems & Contractors LLC, First Mercury Insurance Company and Gemini Insurance Company in the 24th Judicial District Court on June 4.

The Greenbergs contend they contracted with Guardian on Aug. 26, 2013 to install a new roof at their home. The plaintiffs assert that on March 5, 2014 Guardian provided a 10-year warranty on their new roof. The Greenbergs claim that after the new roof was installed they noticed leaks, which was corroborated by Guardian roofers sent out to look at the roof. The plaintiffs allege the roof continued to leak and despite producing a plan to fix it,Guardian never did so and the ongoing leaks have caused interior damage.

The defendant is accused of breach of warranty.

An unspecified amount in damages is sought for property damage.

The Greenbergs are represented by Gary J. Giepert of the New Orleans-based Giepert Law Firm LLC.

The case has been assigned to Division N Judge Stephen D. Enright Jr.

Case no. 750-355.
