Crew member sues for compensation over smashed hand

A Jefferson Parish seaman is suing a Delaware company doing business in Louisiana alleging workplace negligence in connection with the plaintiff’s 2014 injury on a tugboat.

Joshua C. Cann Sr. sued American River Transportation Co. LLC (ARTCO) in the U.S. District Court of the Eastern District of Louisiana on July 15 alleging serious damage to his hand in August 2014 when the vessel was docked in the Mississippi River off Ama, La.

The filing indicates that Cann was helping to transport heavy metal grating on or about Aug. 27, 2014, when the grating allegedly moved, smashing his left hand.

The suit states that the plaintiff incurred medical expenses of approximately $3,000, was rendered unfit for duty, and remained incapable of returning to work for several months.

According to the suit, the defendant failed to provide a reasonably safe workplace, provide adequate tools and personnel, and keep the vessel in a safe condition.

The plaintiff claims pain, suffering, disability, anguish, medical bills, and lost earning capacity. Requesting compensation in the amount of $150,000 plus interest, attorney’s fees, expenses, and court costs, the plaintiff is represented by Alonzo T. Stanga III of Stanga & Mustian in Metairie, LA.
