GRETNA – A Lafitte man is suing a local cable company claiming it left cabling on his property which he ran over with his ATV nine years later, causing him to suffer disabling injuries.
Jorge A. Fernandez filed suit against Cox Enterprises Inc., Cox Communications New Orleans, Cox Communications New Orleans Inc. and their insurers in the 24th Judicial District Court on June 10.
Fernandez asserts that on Sept. 6, 2014 he was driving an ATV in front of his home in Lafitte when the rear axle was caught in discarded cable owned by Cox Enterprises. The plaintiff claims the ATV almost flipped in the incident and he was thrown onto the ground. Fernandez contends the cable had been left in the area nine years ago by the defendants.
The plaintiff alleges he suffered disabling and severe injuries in the incident including back injuries.
The defendant is accused of failing to remove discarded cable, failing to inspect the work site, failing to warn of buried cabling, failing to ensure the cable was removed, failing to supervise subcontractors and failing to inspect the worksite.
An unspecified amount in damages is sought for physical pain and suffering, medical expenses, loss of enjoyment of life, loss of wages, loss of earnings and so of nearing capacity.

The case has been assigned to Division H Judge Glenn B. Ansardi.
