Steakhouse customer claims he was struck, injured by a moving cart

NEW ORLEANS — A customer sitting in a steakhouse parking garage is suing the restaurant she was eating at, claiming an employee lost control of a cart full of materials and injured her.

Katrina Milton filed suit against Dickie Brennan & Company, L.L.C. and Zurich American Insurance Company in the Orleans Parish Civil District Court on June 10.

The suit claims that the petitioner was seated on a bench in the garage next to Dickie Brennan's steakhouse restaurant, when suddenly an employee lost control of a cart full of materials causing it to roll freely down the ramp of the garage and strike the plaintiff, causing her serious injuries and damages. 

The employee is accused of failing to maintain control of the cart, overloading the cart, and failing to use reasonable vigilance. 

The plaintiff seeks an unspecified amount in damages for paste, present, and future physical and mental pain and suffering, medical expenses, lost wages, and attorney's fees.

Milton is being represented by William E. Mura, JR. and Warren A. Forstall Jr. of New Orleans.

This case has been assigned to Div. L Judge Kern A. Reese.
