Several New York corporations are suing VT Halter Marine, alleging it supplied an inoperable tug and barge unit.
Bouchard Transportation Co., BTC B, No. 270 Corp. and Tug Kim Bouchard Corp. filed a civil action complaint Aug. 26 in U.S. District Court Eastern District of Louisiana against VT Halter Marine Inc., alleging breach of contract, breach of warranty and negligence.
According to the complaint, on Feb. 7, 2013, the plaintiffs contracted defendant VT Halter Marine, doing business in Louisiana, to build a tug and barge unit to be delivered to a shipyard in Pascagoula, Miss. The suit says after receiving the unit, the plaintiffs experienced significant problems with it, including electrical and circuit breaker problems and clean water ballast system defects.
The lawsuit states the plaintiffs notified VT Halter Marine of the problems and gave the defendant an opportunity to repair them, but the defendant did not do so.
The complaint states the plaintiffs have suffered costs of repair, loss of profits, incidental expenses, loss of business opportunities and reputation and potential lost revenues in the future as a result of the inoperable unit.
The plaintiffs seek damages, plus court costs and attorney fees. They are represented by attorneys Jefferson R. Tillery and Marc C. Hebert of Jones Walker in New Orleans.
