Couple charges Walmart with negligence, alleging profound psychological and physical damages in fall

A Tangipahoa Parish couple is suing major U.S. retailer Wal-Mart alleging premises negligence in 2014 which allegedly led to permanent injuries for the wife and life-changing marital difficulties.

Gloria Coslan and Joseph Coslan of Tickfaw, La. sued Wal-Mart Stores Inc. of Benton, Ark. and doing business in Louisiana in the U.S. District Court of the Middle District of Louisiana on June 3, alleging negligence at the store’s Hammond location in August 2014 when Gloria allegedly slipped and fell.

According to the lawsuit, when the plaintiff was a patron at the store on or about Aug. 30, 2014, she was shopping near the meat counter when she slipped in a puddle and fell to the floor. The suit states that a first responder at the scene informed her that an air conditioning vent was leaking.

The suit states that the defendants were negligent in failing to protect customers’ safety, properly train and supervise employees, discover and correct dangerous conditions, and maintain HVAC equipment.

Gloria Coslan avers severe physical, psychological and emotional trauma, loss of pleasure in life and use of body parts, limited ability to earn income, perform everyday household chores or participate in recreation, and ongoing medical treatment. Her husband avers anguish, distress and loss of consortium, stating that “she is not the same person that she was before the accident” and that their relationship has deteriorated.

Requesting compensation of more than $75,000, pre- and post-judgment interest, attorney’s fees, expenses, and court costs, the Coslans are represented by Michael Hingle and Bryan Pfleeger of Michael Hingle & Associates in Hammond.
