Louisiana workers sue Classic Southern Home Construction, alleging unpaid overtime

A group of workers is suing a Jefferson Parish-based construction company, alleging they were not paid overtime wages.

Employees Jose Rios, Jose Hernandez, Modesto Rivera, Orlando Alcides, Jeovany Juares, Walter Maradiaga and Eduardo Chaverria, on behalf of themselves and other persons similarly situated, filed a lawsuit Sept. 3 in U.S. District Court for the Eastern District of Louisiana against Classic Southern Home Construction of Gretna and Richard Bates, alleging they violated the Fair Labor Standards Act.

According to the complaint, from June 2013 to March 2015, the workers were employed by Classic Southern Home Construction to do sheet rocking and painting at sites in Missouri, Georgia, Indiana, Louisiana, Texas and other states. The suit says they often worked more than 40 hours per week and were not compensated at the time-and-a-half overtime rate.

The plaintiffs seek a jury trial, unpaid wages, interest, liquidated damages, plus attorney fees and costs. They are represented by attorneys Roberto Luis Costales and William H. Beaumont, both of New Orleans.
