Couple sued for allegedly not disclosing problems with prior to property sale

NEW ORLEANS – A man is suing a couple who he claims sold him a house with a faulty pool.

Darrell Daws filed suit against George F. Sins and Amy Pyrex Sins in the Orleans Parish District Court on July 2.

Darrell Daws claims George and Amy Sins had full knowledge of a defective pool when they sold him property but failed to disclose this prior to the sale. Daws also claims the Sins misrepresented details about “Right of Access” and land rights concerning the property.

The lawsuit states the plaintiff purchased a property located at 6728 Bellaire Drive in New Orleans from the defendants on May 27, 2014. The plaintiff alleges he was immediately required to repair a defective pool filtration system and that within months he discovered problems with the pool and patio’s tiling and flagstones. The plaintiff alleges that the pool was known to be in defective condition prior to the sale.

Daws also alleges that the Sins expressed to him that a lawsuit concerning a portion of land relating to the property would benefit him in terms of usage when settled but that this was a misrepresentation of the facts of the suit.

The defendants are accused of fraudulently misrepresenting the details of a lawsuit pertaining to the property for the purpose of persuasion, negligent misinformation concerning the defective pool, breach of contract and intentional infliction of emotional distress.

An unspecified amount in damages is sought for loss of use, mental anguish, physical injury, and attorney’s fees.
