Orleans Parish man sues Walmart after he was injured on the job

NEW ORLEANS – A New Orleans man has sued Walmart after he was allegedly injured on the job and subsequently terminated from his position.

Derick Toussant filed suit against Walmart in Orleans Parish Civil District Court.

Toussant claims he was hired by Walmart in May of 2014 as a maintenance associate and on June 28, 2014, he was injured while on the job. According to the lawsuit, the plaintiff was terminated on Aug. 19 after four “coaching sessions.”

The plaintiff alleges that the defendant, aware of his job injury and potential claim for worker’s compensation, intentionally caused him to be written up four times which required termination under store policy.

Toussant asserts that some of the write-ups were made to look like they occurred before his injury, however, the petition alleges that all four occurred post-injury.

The plaintiff seeks damages for inconvenience, mental anguish and unlawful termination under Louisiana’s worker’s compensation laws.
