Dual Trucking and Transport sued over alleged late rental equipment fees

A Montana tractor and equipment business claims that a trucking company currently owes them $292,846.30, as well as a late payment charge of 18 percent.

Tractor and Equipment Co. filed a lawsuit against Dual Trucking and Transport LLC and Anthony Alford on Oct. 23 in the U.S. District Court for the Eastern District of Louisiana citing a failure to pay outstanding debts.

According to the lawsuit, Dual Trucking completed a tractor and equipment credit application and faxed it back to Tractor and Equipment on or about March 19, 2012. The application was approved on March 12, 2012, according to the claim, and from March 2012 into 2013, Dual Trucking has incurred late charges totaling $292,846.30, which remains owed and unpaid.

On July 27, 2013, Tractor and Equipment made a demand on Dual Trucking to pay the outstanding debts. Tractor and Equipment is seeking the outstanding amount as well as attorney’s fees and any other relief the court sees appropriate.
