Notice filed for lawsuit over allegedly defective siding to be moved to federal court

Two companies are asking that legal proceedings filed against them by the St. Tammany Parish Coroner’s Office be moved to federal court.

Timber Treatment Technologies LLC of Michigan and Timbersil Distributors of Texas filed a notice of removal on Oct. 20 in the U.S. District Court for the Eastern District of Louisiana.

The St. Tammany Parish Coroner’s Office originally filed a lawsuit against the companies on March 24, claiming of breach of warranty of redhibition, in the 22nd Judicial District Court for the Parish of St. Tammany. The coroner’s office was seeking to recover damages, including, but not limited to, the return purchase price of the allegedly defective siding product, reimbursement of all or replacement costs and other expenses. They are also seeking attorney’s fees, cost and interests, the complaint states.

Timber Treatment Technologies LLC and Timbersil Distributors of Texas seek to remove the suit to federal court, citing that the matter exceeds $75,000. The companies are represented by New Orleans-based attorneys Richard King and Olivia Y. Truong of Melchiode Marks King LLC.
