NEW ORLEANS – Two former laborers for Rimax Contractors have filed a class-action lawsuit against the company, claiming they and other workers were not paid for overtime.
Oscar Veliz and Jose Mejia filed a class-action lawsuit Nov. 27 in the U.S. District Court for the Eastern District of Louisiana against Rimax Contractors Inc. and owner-operator Ricardo Arbelaez, alleging violations of the Fair Labor Standards Act.
According to the complaint, Veliz and Mejia worked in 2013 and 2014 as general laborers for Rimax, earning between $17 and $18 an hour for the seven-day-a-week job. The suit says Rimax routinely required the plaintiffs to work longer than 40 hours in a week, but never paid them time and a half for hours beyond 40.
The plaintiffs seek a jury trial, a declaration that the defendants violated the FLSA, and compensation for unpaid wages and litigation costs. They are represented by New Orleans attorneys Roberto Luis Costales and William H. Beaumont.
