Underwriters sue Atlantic Speciality Insurance Co. over coverage issues with boat crashes

NEW ORLEANS – An overseas insurance company is suing a Hammond-based insurance company over which entity should bear more financial responsibility in connection with a tug boat they both insured, which was involved in a crash.

P&I Underwriters filed a lawsuit on Sept. 15 against Atlantic Specialty Insurance Co. in the Eastern District Court of Louisiana regarding the interpretation of a marine insurance policy.

P&I Underwriters insured L&L Marine Transportation Inc., specifically the vessel Angela Rae that was involved in the transportation of a barge on Dec. 29, 2013, and the sinking of another vessel - Miss Dorothy - also hired to transport the barge along with the Angela Rae.

P&I Underwriters believes it only covers the loss of Miss Dorothy once the hull policy of the tug boat, covered by Atlantic Specialty Insurance Co., is totally exhausted.

P&I Underwriters, which is seeking to recoup fees and expenses in defense of L&L Marine Transportation Inc., is represented by Henry E. Morse and Emmitt L. Dubose III of Duncan & Sevin LLC of New Orleans.
