Wheelchair-bound woman accuses New Orleans of violating ADA

NEW ORLEANS – A St. Tammany Parish woman says there aren’t enough handicapped-accessible parking spaces in the French Quarter, and is suing the City of New Orleans to correct the situation.

Yadi Mark filed a lawsuit Dec. 24 in U.S. District Court for the Eastern District of Louisiana against New Orleans City and its mayor, Mitchell J. Landrieu, alleging violations of the Americans with Disabilities Act and the Rehabilitation Act of 1973.

According to the complaint, Mark, who is wheelchair-bound, has had great difficulty using the handicapped-accessible, on-street parking spaces in the French Quarter. The plaintiff claims there is an inadequate number of accessible-designated spaces, hindering her from access the services and programs offered in the French Quarter.

Mark seeks a declaratory judgment stating the city is in violation of the ADA and the Rehab Act, as well as an order for the city to modify to property to comply with the laws. In addition, she seeks monetary damages and litigation costs. She is represented by attorney Andrew D. Bizer, Garret S. DeReuss and Amanda K. Klevorn of The Bizer Law Firm in New Orleans.
