NEW ORLEANS – A Louisiana couple is suing Kent Mitchell RV and the makers of their recreational vehicle for allegedly selling them a defective vehicle.
Scott and Kelli Toups filed a lawsuit Dec. 29 in U.S. District Court for the Eastern District of Louisiana against D.S. Corp., doing business as Crossroads RV, Kent Mitchell RV Sales LLC and Bank of America National Association, alleging breach of warranty and negligent repair.
According to the complaint, the Toups bought a Crossroads Altitude RV on Jan. 22, 2015, paying $53,517.95, less a down payment of $5,427.02. With finance charges, the suit says the total purchase price will top $75,000. The plaintiffs claim the RV was defective and that the sellers have been unable to repair it, violating the vehicle’s written and implied warranties.
The Toups seek a jury trial, a refund of the price of the vehicle and reimbursement for interest, repairs and legal costs. They are represented by Mandeville, Louisiana attorney Richard C. Dalton.
