ALEXANDRIA – A Georgia man is suing Whataburger Restaurants, claiming he suffered injuries after tripping and falling on a rug in its Lafayette location.
Antonio Jenkins filed a lawsuit Nov. 18 in the 15th Judicial District Court of Louisiana against Whataburger Restaurants LLC, Whataco of Louisiana Inc. No. 971; Tres Aguilas Management LLC, doing business as Whataburger Restaurants Inc.; and ABC Insurance Co.; alleging negligence and personal injury liability.
On Dec. 29, the case was transferred to the U.S. District Court for the Western District of Louisiana.
According to the complaint, Jenkins was visiting the defendant’s store at North University Avenue on Nov. 19, 2014, when he fell after tripping on a rug, suffering torn knee cartilage and cranial pain. The suit says Whataburger and the other defendants failed to keep their store safe for customers, secure the rug to the floor or warn patrons of its potential danger.
Jenkins seeks a jury trial and punitive and compensatory damages. He is represented by attorney of Robert W. Fenet of the Baton Rouge firm Fenet Treadway Gaudin.
