Buyer of GM SUV seeks rescission of sales contract

NEW ORLEANS – A Louisiana man who bought an SUV from Capitol Buick is seeking cancellation of the sales contract over alleged defects in materials and workmanship.

Joseph Michael Hamilton filed a lawsuit Jan. 13 in U.S. District Court for the Eastern District of Louisiana against General Motors LLC, Capitol Buick GMC LLC and Whitney Bank, alleging breach of implied and express warranties and negligent repair.

According to the complaint, Hamilton bought a new GMC Denali XL on July 29, 2014, from Capitol Buick, with financing from Whitney Bank. From the time of its delivery, the suit says the more than $75,000 vehicle presented defects in materials and workmanship, including loss of engine and electrical power, which have persisted despite numerous repair attempts.

Hamilton seeks damages of more than $100,000, including legal costs, and rescission of the sales contract. He is represented by Mandeville attorney Richard D. Dalton.
