NEW ORLEANS – A woman who tripped over a shoe box is claiming that the store is responsible for her alleged injuries.
Kathryn Ichikawa filed a lawsuit on Feb. 15 in the U.S. District Court for the Eastern District of Louisiana against DSW Shoe Warehouse Inc. and XYZ Insurance Co, citing alleged gross fault, negligence and absence of care.
Ichikawa alleges that on Dec. 5, 2015, as she was shopping at a DSW Shoe Warehouse at 1126 S. Clearview Parkway in Harahan, she tripped and fell over a misplaced shoe box. The accident allegedly caused serious bodily harm, which included a right distal radius fracture that required surgery, a chest wall contusion, and bruises on the lower right leg.
Ichikawa alleges that DSW Shoe Warehouse, who is insured by XYZ Insurance, failed in its duty to provide a safe environment and created a hazardous situation which resulted in her fall. In addition, she claims to have suffered past and future medical expenses, loss of wages and mental anguish.
She is suing for reasonable and adequate damages. She is represented by Frank D. Ippolito of the Law Offices of Frank D. Ippolito in Chalmette.
