Doctor accuses DHHS of violating his constitutional rights

NEW ORLEANS – A Jefferson Parish physician and his medical practice are suing the government over its alleged cancellation of his Medicaid and Medicare testing privileges.

Dr. Hai Nam Nguyen, doing business as Gretna Medical Center, filed a lawsuit March 24 in U.S. District Court for the Eastern District of Louisiana against the U.S. Department of Health & Human Services and the Centers for Medicare and Medicaid Services, alleging violation of due process.

According to the complaint, the defendants have sanctioned Nguyen by suspending the practice’s ability to conduct lab tests and receive Medicare or Medicaid reimbursements for them. The suit claims the sanctions were levied because of alleged non-compliance with Louisiana Department of Health and Hospitals regulations, despite Nguyen’s attempts to remedy those issues.

The plaintiff seeks an injunction removing the imposed sanctions. He is represented by attorneys Mindy Brickman and Christy L. McMannen of Christovich & Kearney LLP in New Orleans.
