BATON ROUGE — An East Baton Rouge Parish woman is suing a truck owner, alleging false representation and fraud.
Leslie Swan of Baker filed a lawsuit March 28, in U.S. Bankruptcy Court for the Middle District of Louisiana against Paul E. Carney Sr. of Baton Rogue, alleging violation of the bankruptcy code.
According to the complaint, Swam suffered damages, lost of income and refund of the purchase price paid for a vehicle. The plaintiff alleges Carney failed to furnish her with the endorsed Louisiana title of the 1997 Chevrolet model 1500 extended cab pickup truck, which she purchased for $2,500.
The suit says shortly before Christmas, 2009, using a spare key and without permission, Carney took possession of the vehicle with all of her work tools inside. The defendant refused to return the truck, the previously paid purchase price or her tools.
Swan seeks a trial by jury, an order that the defendant's debt is non-dischargeable and any other relief the court deems proper. She is represented by attorney Howard P. Elliott Jr. of Baton Rouge.
