Customer injured in fall blames Wal-Mart

LAFAYETTE — A Vermilion Parish consumer is suing Wal-Mart, alleging negligence led to her falling and suffering injuries.

Judy L. Stelly filed a lawsuit April 1 in U.S. District Court for the Western District of Louisiana against Wal-Mart Stores, Inc. and Wal-Mart Louisiana LLC,  alleging they failed to properly maintain their store in reasonably safe condition.

According to the complaint, on April 2, 2015, Stelly was shopping in the Lafayette Wal-Mart's frozen food section when she slipped in a puddle of clear liquid and fell on her right knee, then on her left buttock and ended up on her back. The suit says she sustained severe and painful injuries.

The plaintiff alleges the defendants created a hazardous and dangerous condition, failed to properly maintain their equipment, failed to take proper precautions, failed to to warn customers of the unreasonably dangerous condition of the floor, failed to have adequate warnings and/or place safety devices in the area and failed to exercise the required degree of care commensurate with the existing situation.

Stelly seeks a trial by jury, damages for loss of earnings and benefits, past and future, loss of enjoyment of life, medical and related expenses, past and future, all legal costs and any further relief the court deems equitable. She is represented by attorneys Richard R. Kennedy and Richard R. Kennedy of Lafayette.
