Parents allege shopping center's negligence nearly cost daughter her finger

GRETNA – A couple is suing a Kenner store following an incident in which their 3-year-old daughter’s finger was allegedly injured due to a ladder that was left in an aisle.

Jose Acosta and Loany Funez, individually and on behalf of their daughter Brittany Funez, filed suit against La Placita Galleria LLC, XYZ Co. and ABC Insurance Co. in the 24th Judicial District Court on April 12.

According to the claim, Acosta, Funez and their minor daughter were at La Placita Galleria at 2220 Williams Blvd. in Kenner on April 19, 2015, when the minor found a ladder that was allegedly left in an aisle. The child moved the ladder, which closed on her finger, the suit states. After this, an employee allegedly attempted to aid, but purportedly exacerbated the issue, causing the child’s finger to be almost severed from her hand.

The defendants are accused of commission and omission in failing to keep the aisles clear of obstacles and a safe condition, not warning customers of dangerous situations, failing to inspect the store sufficiently, negligence and not properly training employees.

Acosta and Funez are seeking an unspecified amount in damages. They are represented by Leo J. Palazzo, Jason J. Markey, Michael J. Monistere and Mario A. Arteaga Jr. of the Palazzo Law Firm in Gretna. The case has been assigned to Division D Judge Scott U. Schlegel
