NEW ORLEANS – A disabled Metairie man alleges that the Lakeshore Smith-Lupo Center owners have discriminated against him by denying him the benefits of their services, programs and/or activities.
Stephen Carrier filed a complaint on April 26 in the U.S. District Court for the Eastern District of Louisiana against board of commissioners of the Southeast Louisiana Flood Protection Authority, Robert Resources LLC, Alvena F. Lupo, Alvena LLC and Rice & Brackley Property LLC citing alleged failure to uphold Americans with Disabilities Act regulations.
According to the complaint, the plaintiff alleges that he was denied access to the goods and utilize the services offered at the New Orleans property due to numerous architectural barriers. The plaintiff holds board of commissioners of the Southeast Louisiana Flood Protection Authority, Robert Resources LLC, Alvena F. Lupo, Alvena LLC and Rice & Brackley Property LLC responsible because the defendants allegedly failed to make their facilities readily accessible to and usable by individuals with disabilities and failed to make reasonable modifications on their policies and procedures to accommodate disabled individuals.
The plaintiff requests a trial by jury and seeks declaration that defendants' properties are in violation of ADA, an order directing defendants to alter their property to make it accessible to and useable by individuals with mobility disabilities, attorneys’ fees, costs and expenses and such other relief as the court may deem just and proper.
