State Farm files suit over accident in Jefferson Parish

GRETNA – An insurance company seeks damages after an auto accident in Jefferson Parish.

State Farm Fire and Casualty Co., as partial subrogee of Seren Whitaker and Nicole Whitaker, filed a suit against James G. Bessinger Jr. and St. John the Baptist Parish Sheriff's Office in the 24th Judicial District Court on May 2.

According to the claim, the incident occurred on April 28, 2015, when Seren Whitaker was driving his 2003 Chevrolet Suburban on Veterans Boulevard in the vicinity of Massachusetts Avenue. The suit states that the plaintiff was operating his vehicle in a lawful manner when Bessinger Jr. failed to stop at a traffic signal, causing him to strike the plaintiff's car. The suit states Bessinger Jr. is an employee of the St. John the Baptist Parish Sheriff's Office.

The defendant is accused of failure to maintain a lookout on the road, failure to drive in a lawful manner and failing to regard a traffic signal.

State Farm alleges the Whitaker vehicle was a total loss and paid actual cash value of it and other related expenses and seeks to recover the amounts from the defendants. It is seeking an unspecified amount of damages and is represented by James E. Brouillette of Metairie.

The case has been assigned to Division N Judge Stephen D. Enright Jr.
