Consumer accuses agency, debt collector of false reporting

BATON ROUGE — A consumer is suing a reporting agency and debt collector, alleging false and inaccurate reporting.

Justin Hewitt filed a lawsuit May 10 in U.S. District Court for the Middle District of Louisiana Baton Rouge Division against Portfolio Recovery Associates and Experian Informations Inc. alleging violations of the Fair Credit Reporting Act.

According to the complaint, Hewitt disputed information regarding his Portfolio account with a letter to Experian, dated April 8, disputing the inaccuracies on the dates. The suit says he received the results about his dispute, and not only did the defendants not correct, modify or delete the information but they changed the dates. 

As a result, the lawsuit states, Hewitt has suffered emotional and mental pain and anguish. The plaintiff alleges the defendants did not provide or have a good faith investigation into the disputed account as required by law, and penalized Hewitt for exercising his statutory right to dispute inaccurate information on his credit report.

Hewitt seeks trial by jury, compensation for all damages, reasonable attorney fees, legal costs and other relief the court deems proper. He is represented by attorney Jonathan Raburn of The Raburn Law Firm LLC in Baton Rouge.
