Consumer alleges drug manufacturers caused her serious side effects

NEW ORLEANS — A Louisiana consumer is suing a number of drug companies, alleging a design defect caused her to suffer serious side effects.

Yvonne Bemiss filed a lawsuit May 17 in U.S. District Court for the Eastern District of Louisiana against Sanofi SA Aventis Pharma SA and SanofiAventis US LLC, doing business as Winthrop U.S., alleging that they allegedly violated the U.S Consumer Protection Law, design defect, failure to warn and breach of express warranty.

According to the complaint, from April-July 2010, Bemiss underwent six rounds of Taxotere treatment, causing her to suffer serious and dangerous side effects, severe and personal injuries that are permanent and lasting in nature, economic and non-economic damages, harms, losses, mental anguish, severe and debilitating emotional distress, physical and mental pain and impairment. 

The plaintiff alleges the defendants developed, manufactured, warranted, promoted, marketed, distributed and sold the prescription drug Taxotere, used in the treatment of various forms of cancer, failed to provide adequate warnings and failed to disclose that permeant alopecia is a frequent side effect associated with Taxotere.

Bemiss seeks a trial by jury, compensation for all damages, costs, expert witness fees, attorney fees, pre-judgment and post-judgment interest and other further relief as the court deems proper.
